Seoul: A top presidential aide has raised concerns over the recent Supreme Court justice nominations, asserting that the chief justice's actions may have infringed on the president's authority to appoint public officials. Hong Ik-pyo, the presidential secretary for political affairs, voiced these concerns during a parliamentary session, highlighting a potential breach in protocol.
According to Yonhap News Agency, the controversy arose after Supreme Court Chief Justice Cho Hee-dae recommended two sitting regional court judges for appointment as new Supreme Court justices without prior consultation with the president. Cho's recommendations, made in writing, deviated from the customary practice of discussing such matters with the president in person beforehand. This move has sparked a debate over the infringement of the president's appointment powers.
In response to questions from Rep. Cho Bae-sook of the main opposition People Power Party (PPP), Hong remarked, "I share the view that the president's appointment authority has been infringed on to a certain extent." When asked if the recommendations were legally improper, Hong stated that legal conclusions should be drawn after reviewing the procedures, but noted the departure from established customs.
The situation has further escalated political tensions, with the chief justice alleging that Cheong Wa Dae's opposition to his recommendations stems from a desire to appoint justices favorable to President Lee Jae Myung, potentially due to future legal challenges the president might face after leaving office. Hong firmly rejected this notion.
Amidst growing discontent from ruling party lawmakers, some have called for the chief justice's resignation, accusing him of bypassing presidential authority. Conversely, the main opposition party argues that the ruling bloc's actions aim to undermine the chief justice's legal rights and duties in recommending justice nominees. PPP leader Rep. Jang Dong-hyeok emphasized that this authority is crucial in maintaining judicial independence.
