“Tharit” made a statement and accepted the verdict of the Supreme Court.

BMA, July 8-"Tharit" made a statement ready to accept the verdict of the Supreme Court case. "Abhisit-Suthep" charged with killing people and dispersing the 2010 protest on July 10.

Mr. Tharit Pengdit, former director-general of the Department of Special Investigation or DSI, together with a lawyer And the representatives of the relatives of the injured and deceased jointly announced the case against Mr. Abhisit Vejjajiva, former Prime Minister and Mr. Suthep Thaugsuban, former Deputy Prime Minister. As the director of the Emergency Situation Correction Center or CRES, filed a lawsuit against Mr. Tharit. together with a set of investigators in the case of the deaths of 99 people from political violence in 2010, which the case has reached the Supreme Court and Mr. Tharit asked to postpone the judgment 10 times. On July 10

Mr. Tharit confirmed that on July 10 he will go to hear the verdict himself. and ready to listen to the judgment in which direction And if he was sentenced to imprisonment, he was ready to enter the prison as in the case of Mr. Suthep. Charged with building 396 police stations, which has already served 13 months in prison.

Mr. Tharit stated that he had sent a petition to the Supreme Court. Through the Criminal Court to consider sending to the Constitutional Court to interpret whether the prosecution of the plaintiff's 2 allegations under section 157 and 200 steps against the constitution or not. Because this case occurred during the political unrest that caused serious incidents. And in foreign countries, both sections of the law are considered to be contrary to the constitution. because it is a charge of throwing nets against the accused affecting the rights of government officials because it never clearly stated the behavior of the accused, with the CRES set up to control the situation And issued 5 written orders by the director of the CRES, requiring the soldiers to use real weapons to control the situation until more than 2 people were injured, 000 people and 99 deaths in this case, as the former Director-General of the DSI prosecuted the plaintiff for killing others according to the Criminal Code, Sections 288 and 289, but was sued back for performing wrongful acts and persecuting others to receive criminal penalties who considers this charge to be inconsistent with the constitutional law prosecuted

For this case, he acknowledged that it was necessary to postpone hearing the Supreme Court's order several times for 4 reasons: 1. There was no court summons sent to the defendant's domicile. 2. He was sick with COVID-19 twice and was sick cut embolism And had to have kidney surgery on 2 sides but want to become a party as a victim which has to wait for the Supreme Court to consider whether it will accept or not, and 4. is being submitted to the Constitutional Court for interpretation whether the lawsuit filed has a conflict or not and pending the Supreme Court's order which confirms that requesting to postpone hearing each order is in accordance with the law There was no intention of avoiding hearing the verdict.

Mr. Tharit also stated that in this case, the judgment of the Court of First Instance dismissed the lawsuit. However, the Court of Appeal reversed the sentence to imprisonment for all 4 defendants, arguing that the plaintiffs suing the defendants were not guilty. because it is an order for soldiers to use real weapons due to the need to control serious situations Such an order is therefore reasonable, which Mr Tharit stated that if the Supreme Court agrees with the appeal It will show that the prosecution process demanding justice for the deceased's relatives will end. And the judgment of the Supreme Court will be the basis for the judgment of further cases that will occur in the future. because he saw that the order to take action against the protesters was already legitimate

The Court dismissed this case in the Court of First Instance. But in the Court of Appeal that dismissed the case during which the President of the Court of Appeal There was a news that he went to a rally with the PDRC group and during the time when the case reached the Supreme Court. Was promoted to the position of President of the Supreme Court again Therefore, he was very worried about being sentenced. But ready to receive the verdict on July 10

Mr Tharit also claimed that after the protests broke up while serving as Director-General of the DSI There was a soldier involved in the 2014 coup called to negotiate against the prosecution of 99 bodies. “Don't prosecute the 99 dead. If you don't do it, you will revolutionize. and will be transferred first.” After that, Mr. Tharit and Mr. Atthaphon Yaisawang, former Attorney General was ordered to be moved from its original position. And if this case is not done, then someone else will certainly do it. and saw that this was the first time threatening to do this case which has never been disclosed anywhere before For the case of the death of 99 people, there are still 7 years of legal limit left. He urges the new Prime Minister. An independent committee was established at the Senior Super Board level to correct mistakes and ensure fairness to all fatalities and injuries. Although in the past a committee had been set up to study this case

the part that just came out to move and announced to the media due to the unfavorable political situation If he came out to speak, he could see that it would only make it worse. and saw that there was going to be a new government that would be able to provide justice and if sentenced to imprisonment Confirmed that it would not be a free prison. It's not just myself that's going to go to jail.

While Ms. Phayao Akkahad, mother of Ms. Kamolket Akkahad or Nong Kate, a volunteer nurse who died in Wat Pathumwanaram Ratchaworawihan. It is believed that what Mr. Tharit said today was something that had been held in Mr. Tharit's heart for 13 years. What I had been thinking all along was not my own idea. They believe that the 2014 coup has turned the judicial process upside down. It will affect the case of the death of protesters in 2010 because government officials want to cover up this case. Because he knew he was wrong to kill people on the orders of Mr. Abhisit and Mr. Suthep, so all the time that he fought the case after the 2014 coup, he was constantly persecuted by government officials. And if there will be a bleaching movement for Mr. Abhisit and Mr. Suthep I would like to leave you with that, in the year 2010, there were hundreds of deaths. and more than 2 injured, 000 people, where people around the world saw what happened Then people in the justice system in Thailand will see it or not. and would like to say to the new government that Please turn your attention and proceeded to make the truth of this case appear as well

For Nong Kate's case, Mrs. Phayao stated that after the death claim had been identified. The case was silent. therefore went to follow up with the special prosecutor for special cases and was informed that sent the idiom back to the DSI a long time ago But when following the DSI case therefore knowing that the new DSI After the coup, the case was not continued. therefore requesting prosecution of 8 soldiers whose images appear to be holding firearms on the train tracks

The DSI therefore sent the case to the prosecutor of the Military Court to consider the case. And finally, the prosecutor of the military court ordered not to prosecute. because there was no evidence Causing Nong Kate's case to fall, relatives have to prepare to file new lawsuits at the Criminal Court.

As for Mr. Nutpat Akhaad, Ms. Kamonkade's older brother, for the past 13 years, he has always tried to call for prosecution against those involved. But the more you demand, the more you will be prosecuted. And in the past, 44 cases have been prosecuted, including Section 116 for mosquitoes and sedition.

Mr. Tharit added that It would be difficult for relatives to prosecute themselves because they had to find all the evidence themselves. which should be the duty of government officials to prosecute the public

Mrs. Ubolwadee Chant, sister of Mr. Sane Nilruang, who died at the Bon Kai intersection, said that her younger brother was not a participant in the protest. but died while walking into the house in the police flat of Lumpini Police Station, which until now has not had a preliminary investigation and hopes that after this the situation will improve and want Mr. Tharit Do not be sentenced to imprisonment will come to help relatives in fighting the next case

Mr. Chokchai Angkaew, a lawyer who deals with relatives of the deceased, stated that from the incident, 99 people had filed a lawsuit, but only 27 deaths have been investigated and there are still cases that are still in the process. Many more investigators.-Thai news agency
